AN ORDINANCE AUTHORIZING THE OWNERS OF THE RESIDENCE AT 21375 OAK STREET, SMITH TOWNSHIP, MAHONING COUNTY, TO CONNECT TO THE VILLAGE’S WATER MAIN ALONG LAKE PARK BOULEVARD; AND DECLARING AN EMERGENCY

WHEREAS there exists a water main running along Lake Park Boulevard; and

WHEREAS Deborah Schreckengost, the owner of record at 21375 Oak Street has requested permission to tap onto the water main line to create a 1½ “ service line approximately 340 feet in length; and

WHEREAS said service line will in part be required to be placed within the Smith Township public right of way; and

WHEREAS current water regulations require Council approval for any service line outside of Municipal limits greater than one hundred feet.

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1:        That Village Council hereby grants permission for Deborah Schreckengost, the owner of record of 21375 Oak Street, to connect to the Municipal water main line for a 1½ “ service line approximately 340 feet in length.

Section 2:        Permission granted herein is contingent upon the property owner securing written permission from the Smith Township Board of Trustees to utilize a portion of the Smith Township public right of way for the installation of the 1½ “ service line.  Said written permission must be supplied to the Village Utility Office prior to commencement of installation. 
           
Section 3:        That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 4:        That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely provision of safe drinking water.
