AN ORDINANCE AMENDING SEBRING CODIFIED WHEREAS, the Legislative Committee of Council has reviewed Sebring Codified Ordinances Section 339.02 and 351.13 with regard to concerns of commercial vehicles being parked in residential districts; and WHEREAS, the Legislative Committee of Council has reviewed issues involving noise, pollution, impact of gainful employment, safety of commercial motor vehicles being stored off site and a variety of citizen concerns and comments involved with the act of parking commercial vehicles in residential districts; and WHEREAS, the Legislative Committee of Council has recommended that Sebring Codified Ordinance Section 351.13 be amended forth herein. THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF SEBRING, MAHONING COUNTY, OHIO, AS FOLLOWS: Section 1. That Section 351.13 of the Sebring Codified Ordinances "Prohibition of Parking of Commercial Vehicles in Residential Districts" be amended as set forth herein: 351.13 Prohibition of Parking of Commercial Vehicles in Residential Districts. (a) No person shall park a school bus, commercial tractor, truck of more than one ton capacity, bus, trailer, semi-trailer, pole trailer or moving van on any street within the residential districts of the Municipality without first having obtained a limited use parking permit from the Chief of Police. (b) The Chief of Police shall issue a limited use parking permit for parking of a commercial vehicle on a street in a residential district if any of the following apply: (1) The commercial vehicle is a public utility vehicle used for legitimate commercial purpose during regular scheduled working hours or in time of emergency. (2) The commercial vehicle is being used for the construction, reconstruction or remodeling of a residential dwelling or approved accessory building. (3) The commercial vehicle is being used for the loading or unloading of the contents of a family household situated in the immediate area. (c) Commercial vehicles may be parked on private residentially zoned property (with permission of the owner of the real property) provided that they are parked on a gravel or impervious surface that must accommodate the weight of such commercial vehicle. One commercial vehicle per parcel of land may be parked on a residentially zoned property, unless otherwise permitted by Section (b) above. (d) No person shall park a commercial trailer designed to be attached to a tractor or semi tractor on a residentially zoned property within the limits of the Municipality of Sebring. (e) A violation of any provision of this section shall constitute a minor misdemeanor. A separate offense shall be deemed committed each day during or upon which a violation occurs or continues. Section 2. That any provision of Sebring Codified Ordinance 351.13 which is not specifically amended herein shall remain in full force and effect. Any prior inconsistent provision is hereby repealed. Section 3. That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of Section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.
