AN ORDINANCE DECLARING THE NECCESSITY FOR A NEW ONE MILL TAX LEVY IN EXCESS OF THE TEN MILL LIMITATION FOR RECREATIONAL PURPOSES; CERTIFICATION TO THE BOARD OF ELECTIONS UPON WHICH IT WILL BE VOTED BY THE ELECTORATE AT THE GENERAL ELECTION ON MAY 2, 2006; AND DECLARING AN EMERGENCY. WHEREAS the Auditor of Mahoning County, Ohio has certified the amount of taxes that may be raised by each one mill of taxes levied as a new levy and is attached and incorporated herein; and WHEREAS the Council of the Municipality of Sebring, being the taxing authority, has determined that the amount of taxes that may be raised within the ten mill limitation will be insufficient to provide for the necessary requirements of the Municipality of Sebring, and for recreational purposes, pursuant to Section 5705.19(h) of the Ohio Revised Code. NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO: Section 1: That it is necessary to place a new tax levy in excess of the ten mill limitation for the purpose of providing additional revenue for recreational purposes pursuant to section 5705.19(h) of the Ohio Revised Code. Section 2: The amount of the increase in the rate that is necessary to levy shall be one (1) mill for each One and 00/100 Dollar ($1.00) of taxable valuation, which amounts to 10/100’s for each One Hundred and 00/100 Dollars ($100.00) of taxable valuation. Section 3: The emergency levy shall be for a period of five (5) years commencing at the earliest time permitted by law. Section 4: That this levy is an emergency tax in addition to any existing levy or levies in excess of the ten mill limitation for recreational purposes. Section 5: That the emergency levy shall be upon the tax duplicate of the current taxable year 2006 and collected in 2007 and thereafter, provided, a majority of electors voting thereon vote in favor thereof. Section 6: That the question of levying the emergency tax provided herein shall be submitted to the electors of the Municipality of Sebring at the General Election to be held at the usual voting places within said Municipality of Sebring, on the 2nd Day of May 2006. Section 7: That the Clerk of Council be and she is hereby directed to certify a copy of this Ordinance to the Board of Elections of Mahoning County, Ohio, as provided by law and notify the Board of Elections to cause Notice of Election on the question of levying said tax to be given as required by law. Section 8: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring. Section 9: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that this Ordinance will go into immediate effect upon its passage, and no publication of this Ordinance is necessary other than that provided for the Notice of Election.
