AN ORDINANCE AUTHORIZING THE OWNERS OF THE RESIDENCE AT 415 JOHNSON ROAD TO CONNECT TO THE VILLAGE’S EXISTING WATER MAIN ALONG JOHNSON ROAD; GRANTING A SEWER TAP AT 415 NORTH JOHNSON ROAD; AND DECLARING AN EMERGENCY

WHEREAS there is an existing water main running along Johnson Road; and

WHEREAS Steven and Michele Randlett, the owners of record at 415 Johnson Road have requested permission to tap onto the existing water main line; and

WHEREAS current water regulations require Council approval for any service line outside of Municipal limits; and

WHEREAS Steven and Michele Randlett, the property owner of record at 415 North Johnson Road, Smith Township, has requested a sewer tap onto the Sebring sanitary sewer system to provide said property with sanitary sewer service; and

WHEREAS the Village of Sebring has previously prohibited the extension of sewer mains or connections for use outside the Municipal Corporation Limits through the passage of Ordinance 1526-93.

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1: That Village Council hereby grants permission for Steven and Michele Randlett, the owners of record of 415 Johnson Road, to connect to the Municipal water main line through a 1 ½” tap for a service line not to exceed 100 feet in length.

Section 2: That Steven and Michele Randlett is hereby permitted to tap into the Sebring sanitary sewer system to provide for sanitary sewer service to their property located at 415 North Johnson Road.

Section 3: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 4: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to provide for proper disposal of sanitary waste.
