AN ORDINANCE AUTHORIZING AND DIRECTING THE MUNICIPAL MANAGER TO ENTER INTO AN AGREEMENT WITH HARCO LEASING COMPANY FOR THE LEASE PURCHASE OF AN AQUATECH B-10 SEWER CLEANING VACUUMING MACHINE; AND DECLARING AN EMERGENCY.

WHEREAS the Village Council has identified the need to replace a necessary piece of capital equipment used for the maintenance of the storm water and sanitary sewer systems; and

WHEREAS the Village Council has determined that the purchase of an Aquatech B-10 sewer cleaning vacuuming machine will most effectively meet the ongoing needs of the storm water and sanitary sewer system; and

WHEREAS Harco Leasing Company will act as the leasing agent in the lease purchase of the Aquatech B-10 sewer cleaning vacuuming machine; and

WHEREAS funds for the lease purchase have been identified and set aside within the storm water and sewer funds for the lease purchase the Aquatech B-10 sewer cleaning vacuuming machine.

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1: That the Municipal Manager is hereby authorized and directed to enter into an agreement with Harco Leasing Company for a sum not to exceed One Hundred Ninety-two Thousand Nine Hundred Seventy One Dollars and thirty Five Cents ($192,971.35) bearing interest at a rate of 5.37% over a five year period for the lease purchase of an Aquatech B-10 sewer cleaning vacuuming machine.

Section 2: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 3: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely delivery of the Aquatech B-10 sewer cleaning vacuuming machine.
