AN ORDINANCE AMENDING CHAPTER 932.10 OF THE SEBRING CODIFIED ORDINANCE AND REVISING THE MAXIMUM LOCAL LIMITS OF WASTEWATER DISCHARGE; AND DECLARING AN EMERGENCY.

WHEREAS the Village has previously set by Ordinance #1572-95 local limits to be imposed on commercial and industrial users of the sanitary sewer system in order to protect the system against harmful damage and/or sludge removal; and

WHEREAS the Village has proposed to the Ohio EPA modifications to the current local limits to remain in compliance with general pretreatment regulations as well as other existing requirements.

WHEREAS the proposed modifications have been forwarded to the Ohio EPA and received notice that said modifications are appropriate.

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1: That Chapter 932.10 of the Codified Ordinance of the Village of Sebring is hereby amended to read as follows:

Section 2: That any person, firm, corporation, industry or commercial enterprise that violates Section 1 of this Ordinance shall be subject to all applicable Federal, State and Sebring Codified Ordinance Chapter 932 sanctions and penalties as provided by law.

Section 2: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 3: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely implementation of the proposed local limits for the Sebring Sanitary Sewer System.
