AN ORDINANCE AUTHORIZING AND DIRECTING THE MUNICIPAL MANAGER TO ENTER INTO AN AGREEMENT WITH THE BOARD OF MAHONING COUNTY COMMISSIONERS TO RECEIVE FUNDING FOR THE SOUTH SIDE PARK WALKING PATH; AND DECLARING AN EMERGENCY.

WHEREAS the Parks and Recreation Board has identified a need to have a continuous walking path through the South Side Park to promote the health and welfare of the community; and

WHEREAS the Deputy Service Director has estimated the cost of installation of a continuous walking path that utilizes a portion of preexisting sidewalk at Ten Thousand Dollars ($10,000.00); and

WHEREAS the Mahoning County Special Projects Office has invited the Village to submit a request to the Board of Mahoning County Commissioners through the Local Community Development Fund Program for the full funding of Ten Thousand Dollars ($10,000.00) necessary to install a walking path.

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1: That the Municipal Manager is hereby authorized and directed to enter into an agreement with the Board of Mahoning County Commissioners to provide the Village with the full funding of Ten Thousand Dollars ($10,000.00) necessary to install a walking path through the Local Community Development Fund Program.

Section 2: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 3: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely installation of the walking path in South Side Park.
