AN ORDINANCE AUTHORIZING AND DIRECTING THE MUNICIPAL MANAGER TO SUBMIT APPLICATIONS, TO EXECUTE CONTRACTS AND ACT AS CHIEF EXECUTIVE OFFICER FOR THE OHIO PUBLIC WORKS COMMISSION, PROGRAM YEAR 2006, ISSUE II FUNDED PROJECT; NAMELY THE MAPLERIDGE WATERLINE EXTENSION PROJECT – PHASE V, AND ALSO TO ACT AS CHIEF FISCAL OFFICER FOR ALL GRANT DOCUMENTS FOR THE PROJECT AND TO DESIGNATE MS CONSULTANTS, INC. AS THE PROJECT MANAGER; AND DECLARING AN EMERGENCY. WHEREAS the Village of Sebring recognizes the need to extend water lines into the Mapleridge area of Smith Township to provide a reliable and potable source of drinking water; and WHEREAS the Village of Sebring will act as the lead agent in seeking funding with the Smith Township Trustees providing 100% of the local share of funding necessary for the Mapleridge Waterline Extension Project – Phase V. WHEREAS the Village of Sebring hereby requests funding in the amount of Ninety Eight Thousand Seven Hundred Ninety Dollars ($98,790.00) from the Ohio Public Works Commission for the Mapleridge Waterline Extension Project – Phase V. NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO: Section 1: That the Municipal Manager is hereby authorized and directed to make application, enter into an agreement and execute appropriate documents and contracts with the Ohio Public Works Commission for the Maple Ridge Waterline Extension Project – Phase V. Section 2: That the Village Manager, Village of Sebring is hereby designated as Chief Fiscal Officer relative to all grant documents pertaining to the Maple Ridge Waterline Extension Project – Phase V. Section 3: That MS Consultants, Inc. is hereby designated as Project Manager for the Maple Ridge Waterline Extension Project – Phase V. Section 4: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring. Section 5: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely application of the Project to the Ohio Public Works Commission in order to secure appropriate funding for the Maple Ridge Waterline Extension Project – Phase V.
