AN ORDINANCE AUTHORIZING AND DIRECTING THE MUNICIPAL MANAGER TO ENTER INTO A CONTRACT WITH HOWELLS & BAIRD, INCORPORATED FOR A SUM NOT TO EXCEED TWENTY NINE THOUSAND DOLLARS ($29,000.00) FOR PROFESSIONAL ENGINEER SERVICES FOR WEST PENNSYLVANIA AVENUE WATERLINE REPLACEMENT AND PAVEMENT RESTORATION PROJECT; AND DECLARING AN EMERGENCY.

WHEREAS the Village Council recognizes the need to contract for professional engineer services for the West Pennsylvania Avenue Waterline Replacement and Pavement Restoration project; and

WHEREAS Village Council has determined that the proposal submitted by Howells & Baird Incorporated, of Salem, Ohio meets all criteria for the project and falls within the allowable expenditures for the project.

WHEREAS  the Village of Sebring has previously retained the services of Howells & Baird Incorporated on similar projects and determined their work to be satisfactory.

WHEREAS the Village of Sebring has been awarded funds through the Ohio Public Works Commission’s Issue I funding program to fund a portion of the West Pennsylvania Avenue Waterline Replacement and Pavement Restoration project.

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1:        That the Municipal Manager is hereby authorized and directed to enter into a contract with Howells & Baird Incorporated for a sum not to exceed Twenty Nine Thousand Dollars ($29,000.00) for the engineering design and administration of the Pennsylvania Avenue Waterline Replacement and Pavement Restoration project

           
Section 2:        That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 3:        That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely construction of Municipal improvements.
