AN ORDINANCE AUTHORIZING AND DIRECTING THE MUNICIPAL MANAGER TO ENTER INTO A CONTRACT WITH W.E. DOWNIE COMPANY, INC. FOR THE CONSTRUCTION OF THE TEXAS AVENUE BOOSTER STATION PROJECT; AND DECLARING AN EMERGENCY.

WHEREAS the Village Council recognizes the need to engage a professional contractor for the construction of the Texas Avenue Booster Station Project; and

WHEREAS Sealed bids for the construction of the Texas Avenue Booster Station Project, being duly solicited and received by the Village of Sebring, were opened at 11:00 a.m. on March 21, 2006 within Village Council Chambers.

WHEREAS the engineering firm Howells & Baird, Inc, retained by the Village for the design and construction oversight of the Texas Avenue Booster Station Project has indicated that W.E. Downie Company, Inc. has submitted the lowest best bid.

WHEREAS the Village of Sebring has been awarded a grant from the Ohio Public Works Commission in the amount of One Hundred Thirty Five Thousand Forty Seven Dollars ($137,047.00) for the design and construction of the Texas Avenue Booster Station Project.

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1: That the Municipal Manager is hereby authorized and directed to enter into a contract with W.E. Downie Company, Inc., subject to the final approval of the Ohio Public Works Commission, for a sum not to exceed One Hundred Seventy Three Thousand Seven Hundred Fifty Dollars ($173,750.00) for the construction of the Texas Avenue Booster Station Project.

Section 2: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 3: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely construction of Municipal improvements.
