AN ORDINANCE AUTHORIZING AND DIRECTING THE MUNICIPAL MANAGER TO ENTER INTO A CONTRACT WITH MURPHY TRUCKING AND PAVING, BELOIT, OHIO FOR A SUM NOT TO EXCEED TWENTY THREE THOUSAND DOLLARS ($23,000.00) FOR 2007 MUNICIPAL PAVING PROJECTS; AND DECLARING AN EMERGENCY.

WHEREAS the Capital Improvement Committee has identified Municipal roadways in need of repair and has determined that it is more expeditious and in the best interest of the Village to contract for paving services rather than utilize the Service Department personnel; and

WHEREAS the Village has received a proposal from Murphy Trucking and Paving for the resurfacing of certain Municipal roadways; and 

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1:        That the Municipal Manager is hereby authorized and directed to enter into a contract with Murphy Trucking and Paving, Beloit, Ohio for a sum not to exceed Twenty Three Thousand Dollars ($23,000.00) for 2007 Municipal Paving Projects.

Section 2:        That roadways identified for resurfacing under the 2007 Municipal Paving Project are described as follows:

12th Street from Georgia Ave to Rail Road                            (approx 450’   x   23’)
16th Street from Indiana Ave to Maryland Ave                     (approx 320’   x   20’)
17th Street between Maryland Ave and Ohio Ave to Alley  (approx 160’   x   20’)
Oregon Avenue Extension (west of 21st Street)                     (approx 1000’ x   14’)
17th Street between Indiana Ave and Virginia Ave to Alley (approx 150’   x   20’) 

Section 2:        That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 3:        That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely repaving of Municipal roads.
