AN ORDINANCE AUTHORIZING AND DIRECTING THE MUNICIPAL MANAGER TO ENTER INTO A CONTRACT WITH AMERICAN DEMOLITION, INC FOR THE REMOVAL OF THE ABANDONED WASHWATER TANK AND THE ABANDONED STANDPIPE;

WHEREAS the Ohio EPA had conducted an evaluation of the Sebring Water Treatment System on April 5, 2006 to determine its annual compliance with Ohio Administrative Code 3745; and

WHEREAS the Ohio EPA, as a result of its evaluation, has questioned the structural stability of the abandoned washwater tank located at the Sebring Water Treatment Plant and recommended the removal of the abandoned standpipe on Texas Avenue; and

WHEREAS the Village of Sebring has obtained demolition quotes from American Demolition, Inc. for the removal of both water tanks at a cost of Ten Thousand Five Hundred Dollars ($10,500.00).

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1: That the Municipal Manager is hereby authorized and directed to enter into a contract with American Demolition, Inc. for the removal of the abandoned washwater tank located at the Sebring Water Treatment Plant and the Abandoned Standpipe located on Texas Avenue for a sum not to exceed Ten Thousand Five Hundred Dollars ($10,500.00).

Section 2: The Village of Sebring Fiscal Year 2006 Budget is hereby amended to include an additional Ten Thousand Five Hundred Dollars ($10,500.00) within Fund 701 for Distribution-Capital Improvements to provide for the funding of the demolition of the abandoned washwater tank located at the Sebring Water Treatment Plant and the abandoned standpipe located on Texas Avenue.

Section 3: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 4: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that services are necessary to ensure the timely demolition of the abandoned washwater tank located at the Sebring Water Treatment Plant and the abandoned Standpipe located on Texas Avenue
