AN ORDINANCE AUTHORIZING THE OWNERS OF THE RESIDENCE AT 21243 OAK STREET TO CONNECT TO THE VILLAGE’S EXISTING WATER MAIN ALONG LAKE PARK BOULEVARD, AND WAIVING THE WATER TAP IN FEE; AND DECLARING AN EMERGENCY.

WHEREAS there is an existing water main running along Lake Park Boulevard; and

WHEREAS Richard L. and Marcia J Hooper, the owners of record at 21243 Oak Street have requested permission to tap onto the existing water main line to create a service line 285 feet in length; and

WHEREAS current water regulations require Council approval for any service line outside of Municipal limits in excess of One Hundred Feet.

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1:        That Village Council hereby grants permission for Richard L. and Marcia J Hooper, the owners of record at 21243 Oak Street, to connect to the Municipal water main line through a 1 ½” tap for a service line not to exceed 285 feet in length.

Section 2:        That Village Council hereby waives the 1 ½” tap in fee for Richard L. and Marcia J Hooper, the owners of record at 21243 Oak Street.
           
Section 3:        That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 4:        That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely provision of safe drinking water.
