AN ORDINANCE EMPLOYING THE LAW FIRM OF LUNDGREN, GOLDTHORPE & ZUMBAR FOR A PERIOD OF ONE (1) YEAR COMMENCING SEPTEMBER 1, 2006; ESTABLISHING SALARY;REPEALING ANY INCONSISTENT ORDINANCES; AND DECLARING AN EMERGENCY.

WHEREAS Section 6.02 of the Charter of the Municipality of Sebring provides for a Department of Law; Solicitor; and

WHEREAS Municipal Council may appoint a Solicitor and Prosecutor to serve at the pleasure of Council or enter into a contract in writing with a Solicitor and Prosecutor for a period of time not to exceed one (1) year.

WHEREAS Municipal Council deems it in the best interest of the Municipality to enter into a one (1) year contract with the Solicitor and Prosecutor.

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1: That the Municipal Manager is hereby authorized and directed to enter into a certain contract with the law firm of Lundgren, Goldthorpe & Zumbar in accordance with the contract attached hereto and marked “Exhibit A”; and incorporated herein.

Section 2: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 3: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that this Council deems it in the best interest of the Municipality to secure immediate professional legal services.
