AN ORDINANCE RATIFYING AND APPROVING OIL AND GAS LEASES WITH GREAT LAKES ENERGY PARTNERS; AND DECLARING AN EMERGENCY

WHEREAS, the Village of Sebring has previously indicated its intention and desire to lease real estate to Great Lakes Energy Partners for inclusion in oil and gas wells; and

WHEREAS, the Village of Sebring has previously passed ordinances 39-05 and 03-06 authorizing participation in oil and gas leases with Great Lakes Energy Partners; and

WHEREAS, Great Lakes Energy Partners has requested that the Village formally adopt an ordinance specifically identifying the non-surface development oil and gas leases attached  hereto as Exhibits “A”, “B” and “C” which in turn identify specific property owned by the Village of Sebring for inclusion in the oil and gas leases.

THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF SEBRING, MAHONING COUNTY, OHIO, AS FOLLOWS:

Section 1.        This Council hereby confirms that the Village Manager is authorized and directed to execute the non-surface development oil and gas leases attached hereto as Exhibits “A”, “B” and “C”.  The previous execution of the documents attached as Exhibits “A”, “B” and “C” by the Village Manager are hereby specifically ratified and approved.  Pursuant to the Charter of the Municipality of Sebring, this Council has the sole authority to interpret its ordinances and does hereby again confirm that the Manager had, at the time he executed Exhibits “A”, “B” and “C”;  and continues to have the authority to enter into the non-surface development oil and gas leases attached as Exhibits “A”, “B” and “C” hereto.

           
Section 2.        That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of Section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 3.        That this Ordinance is hereby determined to be an EMERGENCY MEASURE, necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Village of Sebring, Ohio and for the further reason that the oil and gas rig for drilling of the wells is currently in the Village and this Ordinance must be adopted  in order to confirm said wells will be drilled with all expedient haste.
