AN ORDINANCE AUTHORIZING AND DIRECTING THE MUNICIPAL MANAGER TO ENTER INTO A CONTRACT WITH CTI ENVIRONMENTAL, INC. TO PROVIDE ENGINEERING SERVICES IN PROVIDING A HYDRAULIC ANALYSIS OF THE SANITARY SEWER COLLECTION SYSTEM FOR A SUM NOT TO EXCEED NINETEEN THOUSAND NINE HUNDRED TWENTY DOLLARS ($19,920.00); AND DECLARING AN EMERGENCY.

WHEREAS the Village Council has previously contracted with CTI Environmental, Inc. to identify areas of inflow and infiltration into the sanitary sewer system to reduce the flow of rainwater runoff into the Sebring Wastewater Treatment Plant; and

WHEREAS a hydraulic analysis of the sanitary sewer collection system is required under the Village’s NPDES permit as the next phase towards the eventual elimination of the Sanitary Sewer by-pass at the waste water treatment plant on January 1, 2010; and

WHEREAS CTI Environmental, Inc. has submitted a proposal to the Village of Sebring to assist the village in developing a hydraulic analysis of the sanitary sewer collection system as required by the Ohio Environmental Protection Agency within the Village’s NPDES permit.

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1: That the Municipal Manager is hereby authorized and directed to enter into a contract with CTI Environmental, Inc. to provide engineering services in developing a hydraulic analysis of the sanitary sewer collection system for a sum not to exceed Nineteen Thousand Nine Hundred Twenty Dollars ($19,920.00).

Section 2: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 3: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that engineering services are necessary to ensure the Village meets the required timeline within the NPDES permit for the elimination of the Sanitary Sewer by-pass at the waste water treatment plant.
