AN ORDINANCE AMENDING ORDINANCE #32-06 AUTHORIZING THE MUNICIPAL MANAGER TO ENTER INTO A RENTAL AGREEMENT WITH KIDZ DAY OUT FOR SPACE AT THE F.A. COMMUNITY CENTER; AND DECLARING AN EMERGENCY.

WHEREAS Village Council has determined that there is space at F.A. Community Center that is appropriate for use as a child day care center and would benefit the residents of Sebring if used as such; and

WHEREAS the Village has passed Ordinance #32-06 establishing a rental agreement with Penny Thompson and Michele Williams d.b.a. Kidz Day Out; and

WHEREAS Village Council and Penny Thompson and Michele Williams d.b.a. Kidz Day Out have determined to modify the previous agreement to their mutual benefit.

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1: That Ordinance #32-06 is hereby amended to include the rental agreement attached hereto, and incorporated herein, with Penny Thompson and Michele Williams d.b.a. Kidz Day Out for space at F.A. Community Center to operate a child day care center. The Municipal Manager is hereby authorized and directed to enter into said agreement with Penny Thompson and Michele Williams d.b.a. Kidz Day Out.

Section 2: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 3: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely operation of the child day care center.
