AN ORDINANCE AMENDING
CHAPTER 171 “INCOME TAX”
OF THE SEBRING CODIFIED ORDINANCES;
AND DECLARING AN EMERGENCY.

WHEREAS, the Council of the Village of Sebring has placed before the electors of the Village of Sebring a ballot issue which would increase the Village income tax to two percent (2%) effective January 1, 2007; and

WHEREAS, the voters of the Village of Sebring have graciously approved the ballot issue increasing the Municipal income tax; and

WHEREAS, this Council desires to amend Chapter 171 of the Sebring Codified Ordinances in order to cause the increase of the Municipal income to take effect as approved by the voters of the Village of Sebring; and

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF SEBRING, MAHONING COUNTY, OHIO, AS FOLLOWS:

Section 1.        That Sebring Codified Ordinance Chapter 171, et seq. which is attached hereto as Exhibit “A” is hereby adopted in its entirety, effective January 1, 2007.                  
Section 2.        Nothing contained herein shall be construed as to reduce, modify, amend, limit or change the income tax requirements set forth in the Sebring Codified Ordinances for the years 2006 and prior.

Section 3.        The effective date of this ordinance shall be January 1, 2007

Section 4.        The Council of the Village of Sebring wishes to express its deep and sincere appreciation to the voters for their trust and confidence for approving the increase in the Village of Sebring income tax on November 7, 2006.

Section 5.        That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of Section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 6.        That this Ordinance is hereby determined to be an EMERGENCY MEASURE, necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Village of Sebring, Ohio and for the father reason that this Ordinance must become effective on January 1, 2007.
