A RESOLUTION DIRECTING THE MUNICIPAL MANAGER TO DE-CERTIFY WATER AND SEWER ACCOUNTS PREVIOUSLY CERTIFIED TO THE MAHONING COUNTY AUDITOR FOR

COLLECTION; AND DECLARING AN EMERGENCY.

WHEREAS, the provisions of Section 743.04(A) of the Revised Code of Ohio and Section 933.06 of the Municipal Ordinances authorizes the certification of delinquent water and / or sewer charges to the County Auditor for collection against the real estate if not paid within ninety (90) days after due date;  and

WHEREAS, the Administrative Assistant of the Division of Water and Sewer, Department of Public Service, has certified the delinquency of  water and sewer accounts; and

WHEREAS, certain of said accounts as certified have since been paid in full and should therefore be DE-CERTIFIED;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

SECTION 1:  That the Municipal Manager be and he is hereby AUTHORIZED and DIRECTED to de-certify and release the delinquent water and sewer accounts listed below  and previously certified to the Mahoning County Auditor for collection on the real estate taxes of the property served as shown below, to wit:

SECTION 2: That along with this de-certification and release, the Municipal Manager be and he is directed to deliver to the Mahoning County Auditor a certified copy of this Resolution.

SECTION 3:  That this Resolution is hereby declared to be an EMERGENCY MEASURE, necessary for the immediate preservation of the public peace, health, safety and welfare; and for the further reason that said certification will enhance the collection of said delinquencies.

WHEREFORE, this Resolution shall become effective immediately upon passage in accordance with the provisions of Section 4.08 of the Charter of the Municipality of Sebring.

SECTION 4:  That it is found and determined that all formal actions of this Council relating to the passage of this Resolution were adopted in open meetings of this Council; and that all deliberations of this Council and of any of its Committees; and of the Planning Commission, if necessary, which resulted in such formal actions were made in compliance with all legal requirements of the Ohio Revised Code, all pursuant of Section 3.11 of the Charter of the Municipality of Sebring.

SECTION 5:  Any notice authorized to be given under this Resolution shall refer to this Resolution by number and codification, when available.
