A RESOLUTION AUTHORIZING THE VILLAGE MANAGER TO FILE AN APPLICATION TO THE STATE OF OHIO TO PARTICIPATE IN THE CLEAN OHIO REVITALIZATION FUND

WHEREAS the State of Ohio, Department of Development, provides financial assistance to local governments for the purpose of addressing local needs; and

WHEREAS the Village of Sebring desires to participate in the Program to receive financial assistance for the Royal Sebring Property Project under the Clean Ohio Revitalization Fund; and

WHEREAS the Village of Sebring has the authority to apply for financial assistance and to administer the amounts received from the state of Ohio, Clean Ohio Council, Clean Ohio Revitalization Fund;

WHEREAS the Village of Sebring must direct and authorize the Village Manager to act in connection with the application and to provide such additional information as may be required

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1:        That the Village Manager is hereby authorized and directed as the official representative of the Village of Sebring to participate with the State of Ohio Department of Development and provide all information and documentation required in said application for State of Ohio Clean Ohio Council, Clean Ohio Revitalization Fund submission.

Section 2:        That the Village of Sebring hereby approves filing an application for financial assistance under the Clean Ohio Revitalization Fund

Section 3:        That the Village of Sebring hereby understands and agrees that participation in the program will require compliance with program guidelines and assurances.

Section 4:        That the Village of Sebring hereby commits itself to provide previously expended monies related to the Phase I and Phase II Brownfield site analysis performed on the Royal Sebring Property as its share of the local match as described in the application.

Section 5:        That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 5:        That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to submit a copy of this Resolution with the project application to the State of Ohio, Clean Ohio Council, Clean Ohio Revitalization Fund application.
