A RESOLUTION DECLARING THE NECESSITY OF AN ELECTION ON THE QUESTION OF APPROVING THE PASSAGE OF AN INCREASE OF ONE-HALF OF ONE PERCENT (0.5%) TO THE EXISTING MUNICIPALITY OF SEBRING INCOME TAX FOR THE PURPOSE OF PUBLIC SAFETY, MUNICIPAL SERVICES, CAPITAL IMPROVEMENTS, ACQUISITION, MAINTENANCE, REPAIR AND REPLACEMENT OF MUNICIPAL PROPERTY AND ALL OTHER MUNICIPAL OPERATIONS AND OBLIGATIONS PERMITTED BY LAW; AND DECLARING AN EMERGENCY WHEREAS, the Municipality of Sebring has had in effect an income tax at the rate of 1.5% since January 1, 1988; and WHEREAS ,in order to address public safety, capital improvements, municipal services, acquisition, maintenance, repair and replacement of municipal property and all other municipal operations and obligations permitted by law; and WHEREAS, the funds available from the existing 1.5% income tax are not sufficient to provide for these services, and this Council has determined that it is in the best interest of the Municipality to submit to electors of the Municipality of Sebring at the November 7, 2006 general election, the question of an increase of one-half of one percent (0.5%) in the existing Municipal income tax, from 1.50% to 2.00%, effective January 1, 2007 and continuing thereafter. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO: SECTION 1: That this Council hereby authorizes and directs the submission to the electors of the Municipality of Sebring, Ohio, at an election to be held at the usual places of voting in that Municipality on Tuesday, November 7, 2006, between the hours of 6:30 a.m. and 7:30 p.m. of that day, of the question of approving the passage of an increase of one-half of one percent (0.5%) to the existing Municipality of Sebring, Ohio income tax, pursuant to Chapter 171 of the Sebring Codified Ordinances, to be effective January 1, 2007 and continuing thereafter. SECTION 2: That it is the desire of this Council that the ballots presented to the electors of the Municipality of Sebring shall be in substantially the following form: A MAJORITY AFFIRMATIVE VOTE IS NECESSARY FOR PASSAGE. Shall the one-half of one percent (.5%) increase to the existing Municipality of Sebring income tax, effective January 1, 2007 and continuing thereafter, for the purpose of providing funds for public safety, capital improvements, municipal services, acquisition, maintenance, repair and replacement of municipal property and all other municipal operations and obligations permitted by law, be passed? ______________ FOR THE INCOME TAX ______________ AGAINST THE INCOME TAX SECTION 3: No provision of this ballot issue shall in any way affect any rights and obligations of the Municipality, any taxpayer, or any other person, official or entity, with respect to the one and one-half percent (1.50%) Municipal income tax levied prior to January 1, 2007 and in effect thereafter as authorized and provided for by and in Chapter 171 of the Sebring Codified Ordinances. SECTION 4: Should a majority of electors of the Municipality vote in favor of passage of the one-half of one percent income tax increase, this Council shall cause an Ordinance amending Chapter 171 to be adopted. SECTION 5: That it is found and determined that all formal actions of this council relating to the passage of this Resolution were adopted in open meetings of this Council; and that all deliberations of this Council and of any of its Committees; and of the Planning Commission, if necessary, which resulted in such formal actions were made in compliance with all legal requirements of the Ohio Revised Code, all pursuant of Section 3.11 of the Charter of the Municipality of Sebring. SECTION 6: That this Resolution is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety, and welfare of the citizens of the Municipality of Sebring, Ohio, and for the further reason that it is necessary to enable the Municipality to provide and pay for needed facilities and services and thereby preserve and protect the property, safety and welfare of the public.
