A RESOLUTION AUTHORIZING THE MUNICIPAL MANAGER TO EXECUTE A SERVICE CONTRACT WITH THE DAMASCUS VOLUNTEER FIRE DEPARTMENT, INC. TO PROVIDE EMERGENCY RADIO OPERATION SERVICES; AND DECLARING AN EMERGENCY

WHEREAS, The Municipality of Sebring and the Damascus Volunteer Fire Department, Inc. have determined that it is necessary to contract with the Municipality of Sebring, Division of Police Dept. of Safety, for the extension of emergency radio operation services.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1:         The Municipal Manager is hereby authorized to execute a contract with the Damascus Volunteer Fire Department, Inc. for a period ending on February 28, 2010, in accordance with attached Exhibit “A”. 

Section 2:         That it is found and determined that all formal actions of this council relating to the passage of this Resolution were adopted in open meetings of this Council; and that all deliberations of this Council and of any of its Committees; and of the Planning Commission, if necessary, which resulted in such formal actions were made in compliance with all legal requirements of the Ohio Revised Code, all pursuant of Section 3.11 of the Charter of the Municipality of Sebring.

Section 3:         That this Resolution is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety, and welfare of the citizens of the Municipality of Sebring, Ohio, and for the further reason that the citizens of the Municipality of Sebring shall benefit by a centralized emergency radio operation service under the Mutual Aid Agreement for the additional protection of Sebring residents in the event of an emergency.

Section 4:         Any notice authorized to be given under this Resolution shall refer to this Resolution by number and codification, when available.
