A RESOLUTION ACCEPTING THE AMOUNTS AND RATES AS DETERMINED BY THE MAHONING COUNTY BUDGET COMMISSION AND AUTHORIZING THE NECESSARY TAX LEVIES AND CERTIFYING THEM TO THE COUNTY AUDITOR; AND DECLARING AN EMERGENCY.

WHEREAS the Council of the Village of Sebring, Mahoning County, Ohio, in accordance with the provisions of law has previously adopted a tax budget or has been granted the authority by the Mahoning County Budget Commission to waive this requirement for the next succeeding fiscal year commencing January 1, 2008; and

WHEREAS the Budget Commission of Mahoning County, Ohio, has certified its action thereon to this Council together with an estimate by the County Auditor of the rate of each tax necessary to be levied by this Council, and what part thereof is without, and what part within, the ten mil limitation.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1:        That the amounts and rates as determined by the Mahoning County Budget Commission in its certification, be and the same are hereby accepted.

Section 2:        That there be and is hereby levied on the tax duplicate of the Village of Sebring the rate of each tax necessary to be levied within and without the ten mill limitation as described in "SCHEDULE A".

Section 3:        That the Clerk of this Council is hereby authorized and directed to certify a copy of this Resolution to the County Auditor of Mahoning County, Ohio.

Section 4:        That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Resolution or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 5:        That this Resolution is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely implementation of the 2008 fiscal budget.
